5 Common Mistakes That Can Hurt Your Accident Claim

Even well-intentioned decisions after an accident can damage your case. Here are five mistakes to avoid — and what to do instead.

After an accident, you're dealing with pain, stress, and a flood of decisions. It's easy to make choices that seem right in the moment but end up hurting your claim down the line. Here are five of the most common — and most damaging — mistakes we see.

1. Not Seeking Medical Treatment Right Away

This is the #1 mistake. Many people feel fine after an accident — adrenaline masks pain — and skip the doctor. Days later, the pain shows up, but now there's a gap in your medical record. Insurance companies use that gap to argue your injuries weren't caused by the accident.

What to do: See a doctor within 48 hours, even if you feel fine. Let a professional decide if you're injured.

2. Giving a Recorded Statement to the Other Insurance Company

The other driver's insurance company will likely call you and ask for a recorded statement. They'll frame it as routine. It's not. They're looking for anything you say that can be used to reduce or deny your claim.

What to do: Never give a recorded statement without speaking to an attorney first. You're not obligated to.

3. Accepting the First Settlement Offer

Insurance companies often make a quick, lowball offer — sometimes within days of the accident. It's designed to close your case cheaply before you understand the full extent of your injuries.

What to do: Never accept a settlement before you've completed your medical treatment and spoken with an attorney. Once you accept, the case is closed — permanently.

4. Posting About the Accident on Social Media

A photo of you smiling at a family gathering can be used by insurance companies to argue you're not really injured — even if you were in pain the whole time. Anything you post can and will be used against you.

What to do: Set your profiles to private, and don't post about the accident, your injuries, or your activities until your case is resolved.

5. Not Hiring an Attorney Early Enough

Many people wait until they're overwhelmed to contact an attorney. By then, evidence may be lost, deadlines may be approaching, and mistakes may already be made. The earlier an attorney gets involved, the better they can protect your case.

What to do: At minimum, get a free consultation right after the accident. You don't have to hire them — but you'll know your rights.
