// Motorcycle Crashes

RIDERS GET BLAMED FIRST. WE START THERE.

When a motorcycle goes down, the assumption is often that the rider was speeding or riding recklessly. Insurance companies lean on that assumption hard, because blaming the rider is cheaper than paying the claim. Most of the riders we help were hit by a driver who simply did not see them.

01

The bias problem is real

Jurors, adjusters, and even responding officers carry assumptions about riders. A crash report is not a final determination of fault — it is one person's summary at the scene, often written before medical records, witness statements, or vehicle data are available.

The counter to bias is documentation: the other driver's sight line, the point of impact, road and weather conditions, helmet and gear condition, and independent witnesses who saw the vehicle turn across the rider's path.

02

Florida helmet law, in plain terms

Florida allows riders 21 and older to ride without a helmet if they carry at least $10,000 in medical payment coverage. That does not mean a helmetless rider has no claim — but it does mean insurance adjusters will argue the injury should have been less severe.

A medical evaluation in the first day or two is critical here. Head, neck, and road-rash injuries worsen quickly and the treatment record tells the story.

03

Two things riders often miss

First, uninsured motorist coverage. Florida carries a high rate of uninsured drivers, and a rider's own UM coverage is frequently the largest available source of recovery after a hit-and-run or an uninsured driver.

Second, gear and bike damage. Helmet, jacket, gloves, and aftermarket parts are compensable, and they need photographs and receipts before anything is discarded or repaired.

// Common Questions

Answers, not runaround.

I was not wearing a helmet. Can I still make a claim?

Generally yes. Florida law does not automatically bar a claim for a rider over 21 without a helmet, though the defense may argue about injury severity. An attorney can explain how it applies to your specific crash.

What if the driver says they never saw me?

That statement often helps the rider's case, because drivers have a legal duty to look for motorcycles. It should be documented immediately in the crash report and any recorded statements.

The bike is totaled. Who handles that?

Property damage is handled separately from the injury claim. Photograph the bike in its current condition and keep the repair estimate or total-loss valuation before it is released.

How fast can I be seen by a doctor?

Same day in most cases. Our intake team coordinates treatment with providers who understand motorcycle trauma and bill through the case rather than requiring payment up front.
