FELL ON SOMEONE ELSE'S PROPERTY?

A slip and fall rarely looks dramatic, which is exactly why so many are never reported properly. A wet floor, a broken step, or an unlit stairwell can produce a spinal injury, a fracture, or a brain injury that changes someone's ability to work. The property owner's insurer will be building a defense within hours.

01

The notice question decides most of these cases

Premises cases turn on whether the owner knew, or should have known, about the hazard and had a reasonable opportunity to fix it. A spill that happened thirty seconds before you walked by is a different case than a leaking freezer that has been pooling water for weeks.

That is why evidence of prior complaints, maintenance logs, inspection schedules, and camera footage matter so much. Those records belong to the property owner, and they need to be requested early.

02

Do not rely on the incident report

Store managers often ask you to fill out an incident report and then describe the fall as your own fault. Those forms are written by the company and reviewed by its claims department. Sign only what is factually accurate, and never write a guess about the cause.

Camera footage is the single most perishable piece of evidence in a premises case. Many systems retain only fourteen to thirty days. If nothing else happens today, get the fall reported and footage preservation started.

03

What to document before you leave

Photograph the hazard exactly where it is — the water, the broken tile, the missing handrail, the burned-out light — and include something for scale. Get the name and title of the person who took the report, plus the names of anyone who saw it happen.

  • Photograph the hazard and the surrounding area before it is cleaned or barricaded.
  • Ask for a copy of the incident report before you leave the property.
  • Save the shoes and clothing you were wearing, especially if the surface was slippery.
  • See a doctor the same day and describe exactly how you fell and what you hit.

// Common Questions

Answers, not runaround.

What if there was no wet floor sign?

The absence of a warning sign is evidence, but it is not automatically negligence. The case depends on how long the hazard existed and what the owner's inspection practices were. Photographs taken immediately are important here.

I fell in a rental apartment. Who is responsible?

It depends on the lease and on who controlled the condition. Landlords generally have obligations for common areas and for hazards they were notified about. Bring your lease to the review.

Can I file if I fell in a private home?

Possibly, if the homeowner's negligence caused the fall and there is homeowner's insurance coverage. These cases are reviewed individually because the available coverage is usually smaller.

How long does a slip and fall claim take?

Minor claims can resolve in a few months; disputed ones take longer. Your treatment timeline usually drives the schedule, because a claim should not be settled before recovery is understood.
